Employment Contracts in Malawi

  • Professional employment in Malawi always starts with an official letter of employment. 
  • In most cases, employers can include a probation period that can’t exceed 12 months. 
  • An employer can end an employment contract early if the employee violates the conditions of their contract. 
  • Employees are entitled to 1 month’s notice if they are paid monthly. This shrinks to 15 days if the employee is paid bi-weekly. 
  • Severance pay is required for employees who have served for longer than a year. Severance is equal to 2 weeks’ pay for each year of service from the 1st to 5th year. This increases to 3 weeks’ pay for each year completed from the 6th to 10th year. This increases again to 4 weeks’ wages for each year from the 11th year onward. 

Working Hours in Malawi

  • The working week in Malawi runs from Monday to Friday. 
  • Full-time employees generally work 8 hours per day, 48 hours per week. 
  • Employees are not allowed to work more than 40 hours per week without receiving overtime pay. 
  • Employees are entitled to a higher hourly rate for overtime. This is 150% of the basic rate which increases to 200% for working on holidays.

Annual Leave in Malawi

  • Malawi has 12 official national holidays. 
  • Employees are entitled to 18 days of paid annual leave every year if they work 6 days a week and 15 days if they work 5 days a week. 

Sick Leave in Malawi

  • When an employee is unable to attend work due to illness, they need to get a doctor’s note and present it to HR as soon as possible.  
  • Employees are entitled to up to 4 weeks of sick leave as long as they have served more than a year at the company. 

Maternity / Paternity Leave in Malawi

  • According to Malawian law, female employees are entitled to 8 weeks of maternity leave. 
  • Female employees can only benefit from maternity leave once every 3 years. 
  • Male employees are not entitled to paternity leave. 

Tax Laws in Malawi

  • Employers in Malawi are responsible for withholding all taxes and social contributions. 
  • Employers contribute the equivalent of 10% of the employee’s salary to their social security fund, while employees contribute an additional 5%.
