Employment Contracts in Azerbaijan

  • Professional employment in Azerbaijan should come with an official letter of employment. 
  • Employers can have a probation period of 3 months in their contracts.  
  • The employment contract should specify its nature and describe the employee’s role. 
  • An employer can end the contract early if the employee violates the conditions of their employment contract. 
  • Employees are entitled to 3 days’ notice during their probation period. 
  • The standard notice period for most workers is set at 2 months. 
  • Severance pay is required for employees in Azerbaijan if they have been employed for more than a year. If the employee has been made redundant, a minimum of 3 months’ pay is required. If they are being let go for other reasons, they are required to receive 1.4 months’ pay for service under 5 years.  
  • This increases to 1.7 months’ pay for service between 5 and 10 years. Over 10 years, the severance pay is 2 months’ pay. 

Working Hours in Azerbaijan

  • Full-time employees generally work 8 hours per day, 40 hours per week. 
  • Part-time employees work 20 hours per week. 
  • Employees are entitled to a higher hourly rate for overtime. This is generally 200% of the normal hourly rate.

Types Of Leave

Annual Leave in Azerbaijan

  • Azerbaijan has 17 official national holidays. 
  • Employees are entitled to a minimum of 21 days of paid vacation. 
  • Employees get 2 days of additional leave per year if they have been working for the company for more than 5 years. An additional 4 days for 10 – 15 years of service. 

Sick Leave in Azerbaijan

  • Employees are entitled to 14 days of paid sick leave. 
  • Sick leave is dependent on the employment contract for each company and employee.  
  • Additional time can be taken, but the employer is not required to pay for that leave. 

Maternity / Paternity Leave in Azerbaijan

  • According to Azerbaijani law, female employees are entitled to 126 days of paid leave. 
  • Maternity leave should be taken 70 days prior to the birth of the child and 56 days after. 
  • Maternity pay is calculated based on the average pay over the last 12 months. 
  • Pregnant women with children under the age of 3 cannot be terminated. 
  • Male employees are entitled to 14 days of unpaid leave following the birth of their child.

  • Employers in Azerbaijan are responsible for withholding all taxes and social contributions. 
  • Employers contribute 22% towards social security, 0.5% towards unemployment, and 2% towards medical insurance. This totals 24.5%. 
  • Employees contribute 3% towards social security, 0.5% towards unemployment, and 2% towards medical insurance. This totals 5.5%. 
  • The VAT rate in Azerbaijan is set at 18%.  
  • Corporate income tax is set at 20% of the company’s net profit.
