Employment Contracts in Kuwait

  • Professional employment in Kuwait starts with a letter of employment. 
  • In most cases, employers can include a probation period that cannot extend more than 100 days from the start of employment. 
  • An employment contract should specify and describe the employee’s role in detail. 
  • An employer can end the contract early if the employee violates the conditions of their employment contract. 
  • Employees who wish to resign need to inform their employer and serve a notice period of 3 months.  
  • When an employer gives an employee notice, the employee is entitled to a day off per week to look for another job.  
  • Severance pay is required and is set at 15 days’ compensation for each year of service if the employee has been with the company for less than 5 years. This increases to 30 days compensation per year of service after 5 years. 

Working Hours in Kuwait

  • The working week in Kuwait runs from Sunday to Thursday. 
  • Full-time employees generally work 8 hours per day, 40 hours per week. 
  • Employees are not allowed to work more than 40 hours per week without receiving overtime pay. 
  • Employees are entitled to a higher hourly rate for overtime. This is 125% of the normal rate per hour. 

Annual Leave in Kuwait

  • Kuwait has 14 official national holidays. 
  • Employees are entitled to 30 days of paid annual leave every year.  

Sick Leave in Kuwait

  • When an employee is unable to attend work due to illness, they need to get a doctor’s note and present it to HR as soon as possible.  
  • Employees are entitled to up to 15 days of fully paid sick leave. The following 10 days are at 75% pay, and the next 10 days are at 50% pay. 

Maternity / Paternity Leave in Kuwait

  • According to Kuwaiti law, female employees are entitled to 30 days of maternity leave before the expected due date and 40 days after 
  • Pregnant women are also entitled to take 100 days of leave after the maternity leave but are not entitled to pay. 
  • There is no required paternity leave in Kuwait. 

Tax Laws in Kuwait

  • Employers in Kuwait are responsible for withholding all taxes and social contributions. 
  • Employers contribute the equivalent of 11.5% of their employees’ salaries to their social security fund, while employees contribute 10.5%.
