Labor Law in Cameroon

Employment Contracts in Cameroon

  • Employers should always start the employment process with an offer of employment. 
  • Employers can set a probation period in their contracts, but this cannot exceed 6 months. 
  • The employment contract should specify its nature and describe the employee’s role. 
  • An employer can end the contract early if the employee violates the conditions of their employment contract. 
  • Employees are entitled to a notice period that’s set by the Minister in charge of Labor. This ranges depending on the employee and their position in the company.  
  • During the notice period, employees are allowed a day off per week to look for another job. 
  • Severance pay is required for employees in Cameroon. However, this is a percentage of the employee’s annual salary. If the employee has worked for less than 5 years, they are entitled to 20% of their annual salary 
  • This increases to 25% for employees serving between 6 and 10 years. The rate increases again to 30% for employees who have served between 11 and 15 years

Working Hours

  • The working week in Cameroon runs from Monday to Friday. 
  • Full-time employees generally work 8 hours per day, 40 hours per week. 
  • Part-time employees work 20 hours per week. 
  • Employees are entitled to a higher hourly rate for overtime. This is generally 150% of the normal hourly rate for night overtime.  
  • Day overtime is set at 120% of the standard salary rate for the first 8 hours and 130% after 8 hours. 

Types Of Leave

Holidays and Annual Leave

  • Cameroon has 10 official national holidays. 
  • Employees are entitled to 1.5 days of paid leave for every month that they work. This translates to 18 days per year. 
  • National holidays do not count towards your annual leave. 

Sick Leave

  • Employees are entitled to 5 days of paid sick leave per year. 
  • Sick leave is dependent on the employment contract for each company and employee.  
  • If an employee becomes ill or gets injured at work, the employer is responsible for paying for medical expenses. 

Parental Leave

  • According to Cameroonian law, female employees are entitled to 14 weeks of maternity leave. 
  • Maternity leave must be taken 4 weeks before the birth (6 weeks if the doctor orders confinement). 
  • Maternity leave is paid for by the National Social Insurance Fund. 
  • There is no legal requirement for paternity leave in Cameroon. However, fathers can make use of their 10 days of parental leave during this time. 

Tax Law

  • Employers are responsible for contributing an equivalent of 4.2% of the employee’s salary to their social security. 
  • There is also a voluntary insurance of 8.4%. 
  • Employers in Cameroon are responsible for withholding all taxes and social contributions. 
  • The corporate income tax rate is set at 30% of the company’s net profit. There is an additional council tax of 10%, making the total tax 33%. 
  • Personal income tax is based on how much income the individual makes. This is dependent on the tax table listed below.
