Employment Contracts in Burundi

  • Professional employment in Burundi starts with an official letter of employment. 
  • In most cases, employers can include a probation period, but this cannot be longer than 12 months, regardless of the type of position.   
  • An employment contract should specify and describe the employee’s role in detail. 
  • An employer can end the contract early if the employee violates the conditions of their employment contract. 
  • The notice period for employees in Burundi depends on the status of the employee. Senior employees are entitled to 1 month’s notice if they have been with a company for less than 3 years. If they have been with a company for 3 to 5 years, this extends to 1.5 months, and finally, it extends to 2 months if they have been with a company for over 5 years. 
  • Severance pay is required for employees but is dealt with on an individual basis. The rate is 1 month’s pay for senior workers with 3-5 years of experience.  
  • This increases to 2 months for employees serving 5 to 10 years and 3 months’ pay for workers with more than 10 years of service.  

Working Hours

  • The working week in Burundi runs from Monday to Friday.  
  • Working on Saturday is permitted, with some companies offering higher hourly rates. However, it’s typical to have 24 hours of continuous rest in Burundi. This is typically observed on Sundays. 
  • Full-time employees generally work 8 hours per day, 40 hours per week. 
  • Employees are not allowed to work more than 45 hours per week without receiving overtime pay. 
  • Part-time employees work 20 hours per week. 
  • Employees are entitled to a higher hourly rate for overtime. This is generally 135% of the normal hourly rate. When working more than 46 hours during the week, this rate increases to 160% of the normal rate. 

Types Of Leave

Holidays and Annual Leave

  • Burundi has 11 official national holidays. 
  • Employees are entitled to 20 days of paid annual leave every year.  
  • Employees are entitled to this leave after the completion of 12 months of service for the company. Alternatively, leave is aggregated at a rate of 1.66 days per month served.  

Sick Leave

  • Employees are entitled to paid sick leave if they’re unable to attend work due to illness.  
  • The maximum duration of sick leave is 3 months in a calendar year.  
  • Compensation for sick leave is equal to 66.7% of the employee’s daily wage. 

Parental Leave

  • According to Burundi law, female employees are entitled to 12 weeks of maternity leave, but this can be extended to 14 weeks. 
  • Employees must take at least 6 weeks of this leave after birth.  
  • Female employees are entitled to 50% of their salary during maternity leave. 
  • Male employees are entitled to 4 days of paternity leave. 

Tax Law

  • Employers in Burundi are responsible for withholding all taxes and social contributions. 
  • The contribution to social security is equal to 10% of the employee’s salary. This is 6% from the employer and 4% from the employee. This is capped at 450,000 BIF. 
  • Employers’ contribution an additional 3% towards social security, capped at 80,000 BIF. 
  • The corporate income tax rate is set at 30% for both local and foreign companies. 
  • Personal income tax ranges from 0% to 30%, depending on salary.
